Introduction: Battery Compliance Is No Longer Only a Safety File
On August 18, 2027, key provisions of the EU Battery Regulation, Regulation (EU) 2023/1542, will apply. This is not an ordinary compliance document. For the first time, carbon-footprint declarations, recycled-content traceability, and independent CE marking are tied together for battery products.
For cross-border sellers whose products contain lithium batteries, the affected range can extend from 3C electronics and small home appliances to electric toys and energy-storage devices. The regulation sets a maximum fine level of up to 5% of a company's global annual turnover, which is far beyond the profit margin of many sellers. Sellers should therefore plan the compliance route before the product is ready to ship.
1. Core Requirements: Four Battery Categories and Three Hard Tasks
The EU Battery Regulation covers four major categories: portable batteries, starter/automotive batteries, EV batteries, and industrial batteries. Compared with the older Battery Directive, the new instrument is a Regulation, meaning it applies directly in member states without national transposition and should be more unified in enforcement.
The compliance framework can be viewed through three hard tasks.
Carbon-Footprint Declaration
Manufacturers must provide life-cycle carbon-emission data for batteries, covering raw-material acquisition, production, transport and distribution, and recycling or end-of-life treatment. Companies need a full life-cycle assessment based on the EU-recognized PEFCR method, with verification by a qualified third party. The carbon-footprint declaration should be completed before the battery product is placed on the EU market and retained in the technical file.
Recycled-Content Traceability
The regulation sets minimum recycled-content thresholds for certain battery materials. Sellers need to trace the source and percentage of recycled material through upstream supply chains.
The Chinese source highlights the first compliance node in 2031: cobalt 16%, lead 85%, lithium 6%, and nickel 6%. The 85% recycled-content requirement for lead-acid batteries applies after the transition period, while cobalt, lithium, and nickel thresholds are phased and later nodes will raise the percentages further.
Independent CE Marking for Battery Products
Battery products need their own CE conformity assessment and cannot simply rely on the CE certificate of the finished device. Even if the host product has already passed CE assessment, the battery module still needs separate conformity assessment, technical documentation, and CE marking. Sellers that assemble battery packs from common cells may also need system-level safety and performance testing.
2. Three Technical Barriers for Cross-Border Sellers
First, LCA analysis reaches upstream mineral extraction. It may involve the carbon factors of lithium, cobalt, and nickel mining locations and smelting energy-consumption data. Many small and medium-sized sellers lack the ability to collect supply-chain carbon data from first-tier suppliers, let alone second- and third-tier suppliers. Without an LCA report that meets PEFCR methodology, the product may not be ready for EU circulation.
Second, recycled-material traceability must cover the full chain from waste-battery collection, sorting, and smelting to recycled-material reuse. Cross-border sellers often buy batteries through multiple distributors, so supply-chain transparency is limited. Sellers should ask suppliers for recycled-material declaration or RPD files early, verify whether the data source has independent third-party verification, and require suppliers to confirm recycled-content data responsibility.
Third, independent CE assessment for batteries can involve safety standards such as EN 62133, electromagnetic compatibility, hazardous-substance restrictions such as RoHS and REACH, and other evaluations. For small-batch sellers, certification cost can push up product unit cost. Sellers using common cells to assemble battery packs may need additional system-level tests lasting several weeks to several months.
3. Suggested 2027 Compliance Timeline
- 2025: complete product category screening, identify affected SKUs, map battery suppliers and cell sources, and start contacting technical service providers able to prepare EU LCA reports.
- 2026: start carbon-footprint data collection, ask suppliers for raw-material carbon data, assess the feasibility of recycled-material supply, lock compliant supplier channels, and begin CE pre-testing for batteries.
- Early 2027: complete the LCA report and third-party verification, obtain CE certificates, prepare the full technical file, and build an internal compliance ledger for later batches.
- Before August 18, 2027: archive compliance files, update product labels, conduct internal review and mock checks, and confirm that CE marking, carbon-footprint declaration, and recycled-content information are correctly shown on product labels and accompanying files before shipment.
FAQ
Do button cells count as portable batteries? Portable batteries can include button cells, but specific obligations and exemptions should be assessed against the actual product use scenario.
Is the supplier's CE certificate enough? Sellers need to confirm whether the supplier certificate covers the battery product itself. If it only covers cells or cell components while the seller sells a finished battery pack, system-level certification and a complete Declaration of Conformity and technical file may be needed.
Is the 5% fine calculated only on EU revenue? The Chinese source states that the statutory ceiling is based on global annual turnover, not only EU-market turnover. Member-state regulators determine the actual amount within the legal ceiling according to the violation circumstances.
Can recycled-content work wait until 2031? No. 2031 is the first compliance node, but recycled-material supply-chain construction takes time. From 2026, sellers should include recycled-material traceability in supplier-entry requirements.
