Who this is for: brand owners, manufacturers, importers, cross-border sellers, packaging suppliers and compliance teams placing packaging or packaged products on the EU market. The goal is not to turn one supplier statement into a universal compliance conclusion, but to connect each ASIN to its packaging units, economic-operator role, destination Member States, materials and evidence versions.

Checked on: 21 August 2026. This article is based on Regulation (EU) 2025/40 and the European Commission packaging-waste page. PPWR entered into force on 11 February 2025 and generally applies from 12 August 2026. Individual obligations still need to be read with their own deadlines, transitional provisions and later delegated or implementing acts.

Four corrections to keep in the ledger: 12 August 2026 is the general application date, not a single deadline for every technical obligation. The Article 5(5) PFAS thresholds address food-contact packaging and should not be rewritten as a one-size-fits-all ban on every package. PPWR does not create a universal “50/100 recyclability score” for 2028. Labelling, empty space, recyclability and producer registration each have their own provisions, dates and technical-file requirements.

1. Put the legal status and dates into the same evidence ledger

The Commission describes PPWR as covering packaging and packaging waste of all materials and origins, including requirements on manufacturing, composition, reusability or recoverability and waste management. For cross-border sellers, the main risk is usually mixing the general application date with the separate dates for labelling, recyclability, minimisation and national producer registers.

DateWhat can be statedWhat to record
11 Feb 2025PPWR entered into force.Regulation version, market scope and internal assessment version.
12 Aug 2026General application; the Article 5(5) PFAS thresholds for food-contact packaging also apply from this date.Intended use, food-contact surface, material and technical-file or testing status.
12 Feb 2027The Commission is to request or update harmonised standards for measuring packaging minimisation; other provisions also set dates for producer-responsibility identification.National registration, standards and implementing-act status; do not assume one final EU-wide format.
12 Feb / 12 Aug 2028The Commission is due to address the empty-space calculation method and packaging-labelling rules. Harmonised material-composition labelling generally starts on 12 August 2028 or 24 months after the relevant implementing act, whichever is later.Label artwork, material composition, digital-carrier content and destination-language scope.
2030 / 2035Minimisation and the Article 24 empty-space rule progress under their own provisions. Recyclability moves through design-for-recycling criteria and A/B/C performance grades, with recycled-at-scale assessment added from 2035.Functionality assessment, material stream, methodology version and later reassessment.

2. Start the PFAS review with the food-contact boundary

Article 5(5) provides that, from 12 August 2026, food-contact packaging must not be placed on the market when it reaches or exceeds the following values, unless another EU legal act prohibits the relevant concentration more strictly. These are not a universal “1 ppb/50 ppm test pack” for every packaging material, and a threshold cannot be detached from the intended use, material and analytical method.

MeasureRegulatory boundaryEvidence to retain
Any PFAS25 ppb or more by targeted PFAS analysis; polymeric PFAS are excluded from that quantification.Test object, targeted method, quantification range, sample batch and laboratory report.
Sum of PFAS250 ppb or more, measured as the sum of targeted PFAS analysis, with precursor degradation where applicable.Target list, pretreatment or precursor-treatment description and calculation.
PFAS including polymeric PFAS50 ppm or more. If total fluorine exceeds 50 mg/kg, evidence identifying fluorine as PFAS or non-PFAS may be requested for the technical documentation.Total-fluorine result, composition information, supplier material statement and Article 5/Annex VII cross-reference.

Practical sequence: mark food-contact or potentially food-contact units in the BOM first, then check whether REACH, food-contact-material rules or Member State requirements add another layer. A supplier “PFAS-free” statement may be an input document; it does not automatically replace the technical documentation or conclusion required for the applicable legal boundary.

3. Build an ASIN-level packaging evidence record that can be read back

Use the following as an evidence index. It does not mean that every ASIN needs the same test report: the required record depends on packaging use, material, operator role and destination market.

  1. Role and market: manufacturer, importer, brand owner, distributor or fulfilment-service role; the Member State where packaging is first made available; direct-to-consumer supply from a third country; and producer-registration or representative details.
  2. Packaging BOM: list sales, grouped, transport and e-commerce packaging unit by unit. Record material, weight, dimensions, connection method, inks/coatings/adhesives, batch and supplier rather than using “outer packaging” as a catch-all.
  3. Technical file: document the packaging function, product protection and safety requirements. Under Article 10 and Annex IV, explain why weight, volume and layers cannot be reduced further, retaining calculations, tests, modelling or other supporting sources.
  4. Empty space and minimisation: separate sales packaging from grouped, transport and e-commerce packaging. Article 24 sets a maximum 50% empty-space ratio for grouped, transport and e-commerce packaging by 2030, subject to the Commission’s calculation method. Article 10 requires manufacturers or importers, by 1 January 2030, to reduce packaging weight and volume to the minimum necessary for functionality; do not invent category caps such as “30% for food-contact packaging”.
  5. Substances and food contact: record PFAS applicability, total fluorine or targeted analysis, heavy metals, REACH and other applicable chemical requirements. For food-contact packaging, create a separate index for Regulation (EC) No 1935/2004, Regulation (EU) No 10/2011 and other applicable measures.
  6. Recyclability: record packaging category, main material stream, separability, recycling-system assumptions and methodology version. Article 6’s later design-for-recycling acts and A/B/C grades must not be rewritten as a “50/100 score” requirement; mark any uncovered point as open pending the relevant act or method.
  7. Labels and digital carriers: record Article 12 material-composition labelling, reusable-packaging labelling, voluntary recycled-content claims where used, QR/open digital-carrier content and destination-language scope. Do not present a national symbol or internal artwork as a harmonised EU format without the supporting act.
  8. Producer responsibility: under Article 44, check registration, reporting, payments and representative arrangements in each applicable Member State. Read back national systems and data granularity; one country’s number is not automatically a pan-EU registration.
  9. Environmental claims: where a listing or package says “recyclable”, “reusable” or “contains recycled content”, record whether the claim covers the whole packaging unit, one component or all packaging placed on the market by the operator, and link the calculation to the same evidence version.
  10. Change control: retain old and new versions, the reason for change and the reassessment result when materials, suppliers, printing, adhesives, structure, labels or markets change.

4. Six checks before publishing a packaging claim

1. Make the title and H1 specific to PPWR, packaging scope and evidence. Avoid “fully approved”, “inspection-proof” or automatic delisting, detention or penalty outcomes.

2. Keep the Regulation, Commission FAQ, guidance, delegated or implementing acts and national requirements in separate source rows, with the check date and link.

3. State the food-contact boundary before stating the 25/250/50 ppb/ppm thresholds. Without sample and method information, do not turn a supplier sentence into a product conclusion.

4. Use the separate dates for recyclability, labelling, empty space and recycled content. Do not convert later technical rules into a fixed score or icon that is already universally enforceable.

5. Check BOM, tests, claims, images, listing text and EPR records against the same ASIN and packaging version. A visual “recyclability grade” or “compliant” mark is illustrative unless the corresponding evidence exists.

6. Keep separate boundaries for the United Kingdom, food-contact uses, dangerous goods, medical devices, medicines and national environmental schemes. PPWR is not automatically a complete substitute for those regimes.

5. Sources and limits

Primary sources: EUR-Lex: Regulation (EU) 2025/40; European Commission: Packaging waste; and European Commission: PPWR FAQ, 3 August 2026. Later delegated or implementing acts, national registration rules and product-specific legislation may change the assessment.
