EUDR Scope Amendment Is in Force: Check the Product and the Date
For a product team, the immediate decision is narrower than “rewrite every wood, rubber and coffee page.” Identify the exact SKU, find the relevant entry and qualification in the amended Annex I, determine which application date matters, and retain the evidence behind that decision. A catalogue label or a search result is a lead, not a scope conclusion.
Three clocks, three different questions
Regulation 2026/2102 amended Annex I and is already in force. According to the Commission's EUDR overview, the main Regulation will apply from 30 December 2026 to large and medium operators, and to micro and small operators already covered by the EU Timber Regulation. Other micro and small operators have a 30 June 2027 date. The products newly added by the delegated regulation have a further, product-specific 30 December 2027 application date. These dates describe different legal events; none should be used as a substitute for another.
Soluble coffee illustrates the distinction. It is among the added product categories, so an importer can map its product code, ingredients, origin and supplier evidence now. The fact that the amendment is in force does not mean that this newly added category acquired the same due diligence submission date on 18 September. Equally, a future application date is not a blanket statement that a product is safe, exempt from other rules or free of preparation work.
The Annex, not the marketing name, defines the perimeter
The Commission described removals including cattle hides, retreaded tyres, soybeans for sowing, certain vulcanised rubber articles, conveyor and transmission belts, and specified seats. Additions include soluble coffee, some palm oil derivatives and frozen cattle tongues. The seven underlying commodities were not replaced wholesale. Those short descriptions help triage a catalogue, but the amended Annex I supplies the operative product entries and qualifications.
Consider two items sold as “rubber components.” One label may cover a natural-rubber derived product while another uses different material and falls under a differently qualified code. Their shared marketing category proves neither inclusion nor exclusion. Capture the customs classification, composition, intended use and relevant commodity link for each SKU. Where an Annex entry uses an “ex” qualification, do not treat the entire heading as having the same status. Keep the version of the classification decision and the Annex passage that supports it.
Exemptions depend on the transaction and use
The amendment clarifies the treatment of samples and products used for analysis, examination and testing, as well as targeted categories such as waste, used and second-hand goods, packing material and products used to manufacture medicinal products. A word such as “sample” or “packaging” on a product page does not itself establish that a legal condition is met.
For example, a carton used to protect another item in transport must be assessed on its actual role in the transaction; a carton sold as a product has a different factual setting. Compare the order, invoice, customs description and physical use with the Annex wording before recording an exception. If those documents disagree, flag the scope conclusion for review rather than publishing an unqualified exemption claim.
Separate system access from substantive evidence
The Commission also announced implementing rules for the EUDR Information System, including simplified declarations for certain micro and small primary operators and technical API changes. A simpler submission channel does not establish that a product is deforestation-free or produced in accordance with the laws of the country of production. For an in-scope SKU, identify who is responsible for collecting and checking plot, supplier, transaction and declaration information under the applicable rules. Keep this evidence record distinct from the product-scope decision.
A useful first review is one affected SKU, not a sitewide text replacement. Preserve its current listing, record the CN code and classification rationale, locate the amended Annex entry, verify composition and use, identify the operator category and relevant date, then check each public claim against that record. A product can be “under review” while classification facts are missing. That is more accurate than converting a July announcement into a permanent proposal label, or converting an in-force amendment into an immediate obligation for every newly added product.
